Terms of Service

These terms form a binding agreement between you and Andrea Scapini, a private individual established in Italy, operating under the brand “Labthlete” (“we”, “us”). By creating an account you agree to them. If you do not agree, please do not use the service. Nothing here limits your mandatory rights as a consumer under Italian and EU law, which always prevail.

The service

Labthlete records lactate-threshold tests, computes training zones and thresholds, and estimates race performance and pacing. It is provided during a beta: it may change, be interrupted, or contain bugs, and we provide no uptime or fitness-for-purpose warranty during the beta.

Adults only (18+)

You must be at least 18 years old to use the service. It is not directed to anyone under 18.

Not medical advice

Labthlete is a training-analysis tool, not a medical device and not a source of medical advice. Its outputs, thresholds, zones, predictions and pacing plans, are model-based estimates from your own inputs. Consult a qualified physician before undertaking maximal-effort testing or training, especially if you have any medical condition, and understand that exercise and testing carry inherent risks that you assume. Nothing in these terms excludes liability for death or personal injury caused by our negligence, for fraud, or anything that cannot be excluded under law.

Your account & health-data consent

You register with an email and a password (stored only as a bcrypt hash). Because the service processes special-category health data, at sign-up you must give explicit consent (Art. 9(2)(a) GDPR); registration cannot complete without it. You are responsible for keeping your credentials secure and for the data you enter, and must only upload data you have the right to use.

Acceptable use

Do not access others’ accounts, disrupt or circumvent the service’s security or rate limits, scrape at scale, or use the service unlawfully or to provide medical diagnosis to third parties.

Coaches & athletes

A coach can create and manage athlete profiles and view their test data. For profiles a coach creates and manages, the coach acts as an independent controller of that athlete’s data. If you delete your own login, only your own self-owned data is erased; data a coach independently holds under a managed profile remains the coach’s responsibility.

Your data

You keep ownership of the data you enter. You can export it any time from Settings, and deleting your account permanently and irreversibly erases your profile and all associated data. See our Privacy Policy.

Estimates, warranty & liability

Predictions are inherently uncertain and provided “as is” without warranty. To the extent permitted by law, our total liability is limited to the greater of EUR 100 or the amounts you paid us in the 12 months before the claim, except for the non-excludable heads above (death/personal injury from negligence, fraud, and mandatory consumer rights).

Termination

You can delete your account at any time in Settings. We may suspend accounts that breach these terms.

Governing law

These terms are governed by Italian law, with jurisdiction in the courts of the operator’s place of residence, without prejudice to the mandatory consumer protections of your country of residence. You may contact us to resolve any dispute and you retain all statutory consumer rights, including recourse to the Garante and the courts.
